Uttarakhand Halts Sale of 14 Patanjali Products; Ramdev and Balkrishna Face Criminal Charges

Location: Dehradun, Uttarakhand — The Government of Uttarakhand has taken significant regulatory action against Patanjali Ayurved Ltd, a prominent Indian Ayurvedic FMCG company, suspending the licences of 14 of its products as per an order issued on April 15. Concurrently, a criminal complaint has been lodged against the company's high-profile figures, Ramdev and Acharya Balkrishna, for violations under the Drugs and Magic Remedies Act.

This legal trouble coincides with ongoing proceedings in the Supreme Court involving a plea by the Indian Medical Association (IMA) from 2022. The IMA accuses Ramdev of initiating a smear campaign against the COVID-19 vaccination drive and modern medical practices. In response to this plea, the apex court, last month, mandated Ramdev and his associate Balkrishna to make a public apology for issuing misleading advertisements concerning the efficacy of their products.

During recent hearings, Justices Hima Kohli and Ahsanuddin Amanullah scrutinized the duo about their compliance with the court's past directives on promotional content. Despite their "unqualified and unconditional apology" for the contentious ads, the bench expressed dissatisfaction over the visibility and size of their initial public apology. This led to a subsequent order for a more prominent apology, which was published on April 24.

The published apology stated, "In wake of an ongoing matter before the Hon'ble Supreme Court of India, we, in our individual capacity as well as on behalf of the Company, unconditionally apologize for the non-compliance or disobedience of directions/orders of the Hon'ble Supreme Court of India."

The Uttarakhand government's action to suspend the licenses of 14 Patanjali products marks a critical regulatory response to alleged violations by the company, intensifying the scrutiny of Patanjali's compliance with national health and advertising standards. This development highlights the growing tension between traditional and modern medical systems in India, and the legal responsibilities of promoters of alternative medicines.

As the court proceedings continue, the health industry and consumers alike are keenly observing the outcomes, which are expected to have significant implications on the operations of Patanjali Ayurved Ltd and the broader landscape of health product marketing in India.
